Golf Fan Fair (GFF)

Marketplace Terms of Service

These Marketplace Terms of Service (“Terms”) govern the use of the Golf Fan Fair Marketplace (“Marketplace”), a peer-to-peer platform operated by Golf Fan Fair Pte. Ltd. (“GFF”, “we”, “us”).

These Terms apply only to Marketplace listings and transactions.
Purchases made through GFF Pro Shop are governed separately under the GFF Pro Shop Terms of Service.

By listing, browsing, or transacting on the Marketplace, you agree to these Terms.

1. Nature of the Marketplace

  • The Marketplace allows users to list and transact golf-related items directly with one another
  • GFF provides platform access only and does not act as the seller or buyer
  • GFF does not own, inspect, store, authenticate, or take possession of Marketplace items

Transactions are conducted directly between buyers and sellers

2. Seller Responsibilities

By creating a Marketplace listing, the seller confirms that they:
  • Are legally permitted to sell the item
  • Have the legal right and authority to complete the transaction
  • Provide accurate, truthful, and non-misleading information
  • Comply with all applicable laws and regulations

The seller remains fully responsible for the listing, sale, delivery, and condition of the item.

3. Authenticity & Intellectual Property Warranty (Marketplace only)

By listing an item on the Marketplace, the seller represents and warrants that:
  • The item is authentic and genuine
  • The item is not counterfeit, imitation, replica, or unauthorised
  • The seller has the legal right to sell the item
  • All brand names, trademarks, logos, and descriptions used are accurate
  • The listing does not infringe any third-party intellectual property rights

4. Mandatory Seller Declaration

At the point of listing, sellers must acknowledge:

“By publishing this listing, I confirm that the item is authentic and accurately described to the best of my knowledge, and I agree to the GFF Marketplace Terms of Service.”

Providing false or misleading confirmation constitutes a breach of these Terms.

5. No Authentication Obligation by GFF

  • GFF does not verify or authenticate Marketplace items
  • Responsibility for authenticity rests solely with the seller
  • GFF makes no guarantees regarding authenticity, condition, legality, or suitability

Buyers are encouraged to exercise discretion and request additional information from sellers.

6. Listing Review & Enforcement Rights

GFF reserves the right, at its sole discretion, to:
  • Remove or disable listings suspected to be counterfeit, misleading, or non-compliant
  • Request proof of authenticity (e.g. receipts, serial numbers, purchase history)
  • Suspend or terminate seller accounts
  • Withhold payouts pending investigation
  • Cancel or reverse transactions where appropriate

GFF is not required to provide prior notice before enforcement action.

7. Counterfeit & Prohibited Listings

If a Marketplace listing is found or reasonably suspected to involve counterfeit or infringing items:
  • The listing will be removed
  • The seller may be suspended or permanently banned
  • Related transactions may be cancelled
  • Relevant authorities or rights holders may be notified

8. Buyer Acknowledgement

Buyers acknowledge that:
  • Marketplace transactions are peer-to-peer
  • GFF does not guarantee authenticity
  • Purchase decisions are made at the buyer’s own discretion

9. Indemnity

Marketplace sellers agree to indemnify and hold harmless GFF, its directors, officers, and service providers from any claims, losses, damages, liabilities, or expenses arising from:
  • Sale of counterfeit or infringing items
  • Misrepresentation of authenticity
  • Breach of intellectual property rights
  • Violation of these Terms

10. Limitation of Liability

To the fullest extent permitted by law:
  • GFF is not liable for losses arising from Marketplace transactions
  • Any liability is limited to platform fees paid to GFF for the relevant transaction
  • GFF is not liable for indirect, incidental, or consequential damages

11. Account Suspension & Termination

GFF may suspend or terminate accounts without notice for:
  • Breach of these Terms
  • Repeated complaints or violations
  • Conduct that undermines platform trust or integrity

12. Changes to Terms

GFF may update these Terms from time to time.
Continued use of the Marketplace constitutes acceptance of the revised Terms.
